Abstract: Data “sharing” between organisations is an increasingly common practice that takes place in a variety of contexts. Reasons to share data include sale of business, sale of data to raise funds, data broking and subscription services, policy development and law enforcement. Such sharing involves one organisation providing access to or a copy of data to another organisation; it is thus properly described as disclosure under the Privacy Act 1988 and equivalent state and territory legislation. Information can be shared for commercial reasons or for public benefit, by businesses, not-for-profits and governments. In this presentation, we discuss the legal framework under which such sharing takes place and how contracts can be leveraged for better data governance and risk management in the context of data sharing.

Bio: Lyria is Director of the Allens Hub for Technology, Law and Innovation and a Professor and Associate Dean (Research) in the Faculty of Law and Justice at UNSW Sydney. She is also co-lead of the Law and Policy theme in the Cyber Security Cooperative Research Centre and Faculty lead in the UNSW Institute for Cyber Security.
